Gushee does not seem to realize how law works--that a "fundamental right" like abortion, if there is a public option, cannot be excluded for those who choose the public option. It is the same principle that the Supreme Court put in place when it ruled that a Texas school district could not exclude illegal aliens from public education. Since, according to the Court, the 14th amendment kicks in, abortion would have to be included in the health care plan even if Congress were to exclude it in the statute. Someone would sue and would likely win, and thus the exclusion would be overturned. Obama knows this, that's why he's been so coy about it.
