I hear the Vatican is working on a papal bull permitting bigamy. And why not? If the Catholic church can have two popes, why can’t a man have two wifes? Or a woman have two husbands?

So Peter makes the full-bore case for a right to polygamy, as a thought experiment. Shows you how it it is logically demanded by Anthony Kennedy’s most famous statements about “liberty’s evolution” and about the “core of liberty being the right to define one’s own concept of existence.” If you accept the reasoning of Casey, Lawrence, Goodridge, etc., you must admit that the right to polygamy is already there, just as the the right to SSM already is.
Of course, Kennedy and company will deny to the day they die that their jurisprudence logically demands this.
And, the whole push makes the non-marrying kind say, “hey, what about us and our right to define our relationships (or lack of them) and to have these choices equally respected!” One of the Big Think commenters to Peter’s essay draws attention to the Equality for the Unmarried Movement: http://www.unmarried.org/ So, again, the judicial quest for SSM will eventually provoke, unintentionally but entirely logically, into an attack upon ALL marriage.
Living Constitution? More like a Killing Constitution, destroying anything above and beyond equal-autonomy, equal-autonomy, equal -autonomy.
One problem with all these “different” relationship choices is that they are all so anti-erotic. Eros is the desire for the perfect. It seeks all-consuming, perfect union, provides the discovery of one’s true vocation, and at the same time invites perfect self-sacrifice. In the order of nature, this has its expression in the encounter between this man and this woman. The perfection, completeness of what it is to be human is found there. In the order of what contains nature, it is loving God for His own sake.
“Of course, Kennedy and company will deny to the day they die that their jurisprudence logically demands this.”
No, they will deny it only until the day it becomes socially and professionally obligatory to approve of polygamy.
