Michael Schiavo has threatened to sue Terri Schiavo’s family because they named their non profit after her–the “Terri Schindler Schiavo Foundation.”  (MS claims he owns the name. ) And, true to form, an ever compliant media fronted his cause with an unfair attack on the family.  From the story:

Schiavo’s widower, Michael Schiavo, says the family should be ashamed of what they are doing. He adds if Terri ever knew this was happening she’d be horrified. Michael Schiavo is talking about the Terri Schindler Schiavo Foundation. While Terri Schiavo’s brother Bobby says the organization is set up to help families in similar situations, Michael Schiavo says he doesn’t believe it. Instead Schiavo says they are using their deceased sister’s name to make money.

What Michael Schiavo “believes” is irrelevant and beside the point.  Had the reporters wanted to find out the kind of help the foundation offers others, producers could have called me or a myriad of others active in this field, who are quite aware of the selfless giving and effort each surviving member of Terri’s family offers to others.  Indeed, I have personal knowledge of case after case in which the Schindlers worked selflessly–and without financial compensation of any kind–to assist family members save their cognitively disabled loved ones from suffering the same dehydration fate as Terri.  The Lauren Richardson food and fluids dispute and the Andrea Clarke futile care case are just two that come to mind.

And as for profiteering–Bobby Schindler’s salary is $37,500 annually, and all speaking fees he receives go to the foundation.  His sister Suzanne, makes less and is 14 months in arrears in receiving her compensation.  It is also worth noting, that after receiving complaints, the IRS investigated the foundation and gave it a clean bill of health in 2008.

The hatred of this family is pathological and obsessive.

On a personal note: I know Bobby Schindler very well and consider him one of the most decent human beings I have ever met.  His sister Suzanne is a peach, and mother Mary doesn’t have a vindictive or nasty bone in her body.  Father Bob gave everything he had to save his daughter’s life, and seeing her die slowly by intentional dehydration when the family was prepared to love and care for her the rest of her life, destroyed his health and eventually took his life.  I stand wholeheartedly and unreservedly with the Schindler family and against the continual calumny mounted against them.

    Woe to those who call evil good and good evil, as Michael Schivo and his supporters do. This Schiavo character is just a power hungry nut. He got what he wanted in the life of the wife he was openly cheating on (and possibly beat into the handicapped state she was in). But that’s not enough for him. He wants to control the lives of her family too. Possibly he wants to increase the killing of the weak and wants to stop anyone defending the weak.
    He is a [name calling deleted]. He will face God’s judgment someday.

    BTW: he doesn’t own any name except his own. He doesn’t own his wife’s (ex-wife’s) name. To pretend he does shows what a control freak he is.

    Is there something we can do to help? I would love to sign a petition or something saying that I support them. I’m sorry, but I think that Michael Schiavo is a cruel, self-aggrandizing, abusive bastard. He is the one who should be ashamed for abusing his wife (I think he did abuse her) and then abusing her family.

    The Shindler family must be awful poor managers of all that blood money they are supposed to be harvesting from the death of their sibling and daughter. The vilifiers from the main stream media should be able to build a case proving that point if the Lame Stream Media had integrity. However ,they would rather continue the lie that financial gain drives the Shindlers. Journalists with a political agenda have no interest in being honest enough to see the Shindlers are not wealthy and how heavy a price they have paid to show compassion till Terri died of a natural cause instead of from induced starvation.

    Please God!!. It is time to show us your second coming. The power of life & death is being misused by the courts of Law & medicine .

    I care and I wonder where you came up with the point of view that the Shindlers are making financial gain on their daughter & siblings death. Maybe you could provide proof of that claim instead of the personal attack with no substance that you just made.

    NASGA also stands in solidarity with the Schindler family!

    NASGA is an organization of victims and families working to expose and end unlawful and abusive guardianships/conservatorships — a growing national epidemic.

    Guardianship wards are stripped of all rights: the right to decide where to live and whom to associate with, how to spend (or save) ones own money, to accept or refuse medical treatment –or even ask for a second opinion, marry, vote, etc. Most important, wards are stripped of the right to complain.

    With the fox guarding the henhouse and the hens muzzled, guardians and their attorneys can easily unjustly enrich themselves at the expense and to the detriment of the very person they have been court-appointed to protect.

    Many wards are forcibly taken from their homes and isolated in nursing facilities against their will – and family is not permitted to visit or have information or input regarding medical “care.” Wards die prematurely – alone and afraid. The devastation victims and families suffer at the hands of the system haunts them for the rest of their lives.

    And where do the victims go for help? Many go to the AG, only to be turned away because the abuse has been court-sanctioned. Convicted felons have more rights than guardianship wards.

    Couldn’t we say the same about the family of Susan G. Komen and the foundation named after her? Komen raises millions…Terri’s Foundation does not raise even $1M. So sad that this humble and dedicated family is under attack. They have helped over 20 families in TX fight the same painful murder that precious Terri endured. The media remains blind and irresponsible; the plank is so big they couldn’t handle its extraction.

    Michael Schiavo (the history rewriter) says that the family is “using their deceased sister’s name to make money”.

    I should think that malicious allegation, made publicly and supported by facts on record, would be actionable in a court of law. This is America!

    Any lawyers want to take that on pro bono?

    Dale Flannery: Where were you when the fundamentalist crowd was claiming that Mike Schiavo attempted to murder his wife, and that the attempt had caused her to enter a PVS? Anybody want to take THAT libel case pro bono? How about it? Anybody at all?

    HW, you are again wrong on libel law.

    The conspiratorial chattering of any crowd (whether they are correct or not) is of a different category than public statements made by a specific person about someone else. The relationship of the person making (possibly libelous)charges, his or her power to influence opinion, and the damage done by the public statements, are all considered when examining libel cases.

    If one person, perhaps two, could be found to have begun unfounded rumors about Mr. Schiavo being an attempted murderer, then he might have a case to make against that person.

    Speculation made by a group of unknown/regular people who have lived in this world and feel they know what people are like doesn’t count as libel…as least not actionable in court.

    Michael Schiavo is levelling public charges against the family. He is a public figure who has a realtionship (only circumstantial, mind you) to the statements he is making, and he has the potential to do great damage to their public image and to their charity.

    I’d say he is definitely in a position to be sued, at least, for libel, if the Schindler family is interested.

    Surely there can’t be any legal chance for this suit, can there, Wesley? I mean, that really was her name. How can they not be allowed to name their foundation after her?

    Lydia: I don’t know Florida law. Schiavo’s lawyer’s letter says the court awarded the use of the name to him. Schindler lawyer responded it is in the public sphere. So, I don’t know. But if he sued, it would be out of pure vindictiveness since the Foundation honors her memory and helps others similarly situated.

    I will stand by this honorable family forever. When I first met this family at National Right to Life Conventions I was struck by what a normal, everyday, decent family there were. They didn’t ask for any of this, the situation was thrust upon them and they responded as any loving family should. God Bless the Shindlers. And we will never know if Terri’s husband had anything to do with her physical problems as he refused to let an autopsy be performed. Something to hide, Michael?

    Clearly Michael Schiavo is suffering from tremendous guilt and is under the spell of evil; thus he has a need to destroy anyone (the Schindlers) or anything (the Foundation) whose existence reminds him that he killed his wife. It is evil, pure and simple…God will judge him; we can find comfort in the knowledge that ultimately, he will not get away with this.

    I wonder if Michael got nervous after the Family Guy debacle called attention to the inhumane, worldly treatment of Terri’s issue and family ( about which I called, and posted to them). Wish they would just dump the Schiavo name anyway — we all know “Terri” and association with that name is repugnant now.

    This reminds me of Tina Turner when she was divorced from her husband. She asked for nothing except the same Turner and he even refused her that.

    Terri’s husband couldn’t even care about his own wife’s needs and he does sound like an incredible selfish man to let her die like that.

    I’m just appalled by this latest development. IT couldnt pull off the actual effort of killing Terri but left her with enough damage to somehow con a state judicial system to do it in a much more cruel and horrible way. I hope nothing like this would ever be allowed to happen here in Australia but its almost getting laughable now to read that IT is claiming IT owns the name she was given from birth. IT took Terri’s life but IT cannot take her NAME. [Comment that could be construed as threatening deleted]

    I, too, stand 100% behind the Schindler family. Terri was legally married to Michael Schiavo at the time of her legal murder, so of course her family can use that name. It was legally hers. This family has stayed strong and true even as our legal system failed them time and time again. Who ever heard of someone being denied food and water on hearsay evidence? I didn’t think hearsay was even permitted as evidence in ANY court trial, yet it helped murder Terri. That this family is still being harrassed by Michael Schiavo is criminal in itself. Anyone who criticizes the Schindlers should try walking a mile in their shoes.

    This is what I think. I think with obamacare we will all soon be Terri Schiavo one day. She died a horrible death, but because she couldn’t speak up for herself it was dismissed.
    This is what they want for you and me.
    I even heard that fraud Bill O’Reilly quoting some professor from MI saying, in the days leading up to her execution, that people in her situation “don’t feel anything.” I lost all respect for him then.
    As for Michael, he is the poster boy for the Death with Dignity crowd–that is, death for you when we decide you’ve lived long enough enough.
    He has big backers and is protected for doing the devil’s work.

    Dehydration seems to be the chosen method of killing patients now – a cruel death. Terry’s was particularly so, because she was aware, and because her loving family wanted to take care of her. Mocking those good people is surely from the devil, as is the whole culture of death we are enduring. The Schindler family is in my prayers. God bless and keep them all.

    I followed the case pretty closely at the time and, while the name escapes me at the moment, I seem to recall that Michael Schiavo’s lawyer was the real driver behind an awful lot of this tragedy. He was tied in tight to the local judge, and to the so-called ‘Death with Dignity,’ pr-euthanasia crowd.

    What’s the story on this sleazy lawyer’s current involvement, Wes?

    I don’t see my comment, so I’ll try again – Two things:

    1) Why does mike Deeson, the WTSP news reporter doing this story, complain about a small 30-40 grand salary per Foundation employee when he probably makes double that?

    2) I forgot this in my last post, but here goes: Even as this article by Wesley J. Smith points out, the WTSP news report purposely withheld mention of the IRS document clearing the Schindlers of any wrongdoing.

    Yes, I am glad that Mike Deeson and WTSP did the news story and informed me of the facts, but it appears that Mr. Deeson was vindictive and slanted (based on the withholding of the IRS doc & the tone of his voice and his slapping that paper in his hand -I’m hoping Deeson was merely ‘acting’ and not really hateful).

    My post is meant to add ‘balance’ and ‘The Rest’ of the story.

    In my opinion, Michael Schiavo should not have had custody of his wife. He had an overwhelming conflict of interest in that he had a girlfriend and had emotionally moved on from his marriage to Terri when he made those awful decisions that took her life. It was in his interest for her to die. What happened to Terri was nothing less than court-supported murder. The judge who allowed Michael to kill his wife should have been removed from the bench, disbarred and prosecuted in Terri’s death. This case showed how morally corrupted our courts have become. A shameful chapter in American history.

    Yes, Miriam, you are right. “A shameful chapter in American history.” Like somebody said: “this country hit rock bottom the day Terri Schiavo died. It has been the case in human history that has devastated me the most. The name that brings pain to my heart. I can’t understand how we will be prosecuted if we starve our pet, but not a human being. Thank God a final day of judgement is coming and all the ones responsible for her death will be judged.

    Dear History Writer,
    As much as you are allowed to say just about anything you like any time you like does not mean dispensing with common sense and before voicing your opinion. I’m a Nigerian and I think the day America and mankind ‘gets over’ the killing of Terri Schiavo will be a day worse than that when she was allowed to die…

    Just as there are people who with meagre resources who work remind us of events like the Holocaust so that we don’t ‘get over’ that evil even after decades so should the Terri Schiavo Foundation work to remind people of the crime that took place under the eyes of the courts in 2005. That an accusation by someone as questionable as the one who fought for this crime to take place is even the benefit of airtime shows how blind and stupid we men have become.

    For the sake of truth and good some people have to ‘blubber’ and woe to us the day all blubbering stops.

    Perhaps, if that’s the way you look at it, it would be perfectly fine for someone to free YOU from YOUR “shackled life.” Remember: you’re not allowed to protest; people will simply say you’ve given your permission, and will have the same amount of proof that Michael Schiavo had.

    Elementary Deduction:

    MS has spent all of Terri’s insurance money that he killed her to get,
    so now in desperation “he” (I really believe there is no longer a Michael but just a shell entity posessed by demons)
    proposes a frivilous lawsuit attempting to get something more from her family.

    No Schiavo can live or even rest in peace because of him.
    If I had that surname I’d change it, or have it scratched off the family head stones. He’s cursed the name . Evil.

    “Shame on all of you who continue to smear the good name of Michael Schiavo. What he did for Terri in freeing her from that shackled life was Christ-like, and you should be thanking him for that.”

    This kind of statement would be laughable if we were not dealing with a serious matter. To say that Michael’s actions were anything but Christ-like! Have you read…oh it’s no use!

    Mr. Bobby Schindler…
    There not much I can do to support materially. But I can pray and get others to. You can count on that. I still remember following the issue on CNN 5 years ago. Terri’s face is still printed on my memory; a face that even then wanted life. i wondered and still wonder why anyone would see a good (or even Christ-like good) in something as vile as that. There is a lot of poverty where I come from and many sick people. And here the hospitals, despite being filled with the sick are also filled with family members ready to spare no cost in making that that person is not alone. Maybe one day we may grow selfish and decide it is better to ‘mercifully’ terminate the lives of loved ones. When that day comes by God’s grace there will be people prepared to more than just ‘blubber’.

    I still weep for what Our Lord & Savior died for as have millions of other’s who value the human Soul for the last 2000 years. Michael Schiavo ain’t no Christ but he does have the Judas factor working for him in Terri’s case.

    To all reading this post – our organisation Cherish Life Queensland Inc (formerly Queensland Right to Life) in Australia can vouch for the fact that the Bobby Schindler and his sister Suzanne at NO TIME requested any financial renumeration when they came out to speak for our Conference at our request 2 years ago. They were selfless in their efforts to give without expecting return.
    Their hearts are in the right places and it is unforgiveable that the ex-husband of Terri is stooping so low in his continued attacks on the family.

    Shame on the ones that say that “we should get over it” or “don’t smear the name of “Michael Schiavo.” You should really be ashamed of yourself. You obviously don’t have any children. Do you have any idea what it is to be starved to death? I haven’t heard of a more horrific crime than this. I was living in Florida at the time of her death. I wrote to governor Bush, just like many others, begging him to save her life – but evil prevailed and this evil man will always take pleasure in tormenting this beautiful family. I can’t fathom loosing a child, let alone losing him or her in the manner that Terri died. Take heart, Mary, Bobby and Suzanne. They will all be judged. And remember people, yesterday it was Terri, tomorrow it can be our children. And if a country is judged by the way it treats its most vulnerable, than we have really failed.

    Susan, in reference to the murdered babies, if an eight month pregnant woman is murdered, the murderer will be charged with two crimes, yet, a doctor can perform a “partial-birth” abortion and it’s perfectly ok. Does that make sense? Just like we will be prosecuted if we starve our pet, but it’s ok to starve a human being because in this country a human being is worth less than a pet. Mary has been receiving strength from the Lord because I don’t know if I would have been able to withstand something so horrible and tragic. God bless you Mary, Bobby and Suzanne, I love you all. Our soon coming King will be the Judge then.

    I am 100% with the Foundation. You see, this is how the EVIL ones work. They throw the garbage out there and just sit back to see how many stupid people believe their lies. They know they lie, but that doesn’t matter, just to get it out there is doing the harm they want to create,but guess what????     I and my one month old son at the time (he is now 22) were the victims of domestic violence. I could have been killed along with my precious son if I had not entered a shelter, changed my name, and moved out of state. Terri told friends and friends witnessed the awful control of Terri (i.e. checked her mileage on her car, called her repeatedly at work to harrass her to tears, etc.) I believe that Michael Schiavo was seeing his now murdered (through denial of basic care) improving quite a bit. She was even sitting up and having jello, looked very good, and with therapy would soon probably start speaking and tell the truth about what really happened (and it would probably involve Michael Schiavo)! He did not want that to happen so he used the money that was suppose to go to her rehabilitation to get lawyers to support him to take her life. He is the last person who should talk about making money off his wife’s condition! When she seemed to be improving he took complete control over her, her family, her visitors, etc. He denied her any stimulation in her room (no photos, pictures, flowers, etc.) and would not even let her parents take her for a ride in the wheelchair outdoors! She was confined to a bland room with no rehabilitation whatsoever. That way he controlled her to the point of her lack of any further improvement. He allowed her death by dehydration despite the fact that Terri never put such a thing in writing and her parents were willing to completely take over her care for the rest of her life. He did that as well, most likely because they would provide therapy and she would improve (she was NOT dying) and talk about what truly happened that night when Terri and MSciavo were alone. He couldn’t let her do that if he was responsible. I am not saying he definitely caused her injury , but from my experience with domestic violence that is certainly possible. She was going to divorce him and violent men would rather get rid of a woman than let some other man be with her. “If I can’t have you nobody can!” Those are similar words my ex-husband used to terrify me from leaving. But I left and went into hiding (a domestic violence shelter), or I might be dead today along with my sweet infant. Even if per chance MShiavo was not involved initially, he certainly was an accomplice to her death by starvation.

    Bobby, you and your family, know you are right before God, and nothing anyone says to the contrary are lies and misrepresentations. Keep in mind that verse in the Bible that says, “If God is for us, who can be against us”. God loves all of us even those who did those horrible things to your sister, but God’s mercy is only available if people confess their wrongs to Him (and publicly in this case) and ask for forgiveness. “Revenge is mine, says the Lord, I will repay.” That is also in the Bible. God help MSchiavo and his accomplices in her murder when they meet their Creator. He is merciful, but just, and after death it’s too late to make things right!

    God bless you and your family. I am so sorry about your father’s death. He is now with Terri in Heaven. She, contrary to what MSchiavo is saying, is very proud of what you are doing in her name so the same fate won’t be anyone else’s. People who criticze, make fun, and lie about you and what you are doing should be ashamed of themselves and will also be accountable to God someday if they do not take back their horrible words. Love to you and your family. Keep up your good work despite the persecution. Remember, Jesus said we must take up our cross everyday, as he has done for us. You have been doing that everyday and it is not easy. They hated Him and are showing you the same. But the Lord’s Father rewarded His Son and He will greatly reward you as well as upi serve Him to save lives, bringing much good out of terrible evil.

    Dear Mary, Bobby and Suzanne,
    I stand behind you 100%. I can`t believe that the evil Michael Schiavo is still torturing you in threatening you with a law suit. One day he will get the punishment he deserves for what he did to Terri. As for him “owning” the name Schiavo, it was Terri`s legal name as his wife. Just because he wanted to be rid of her to marry his girlfriend, doesn`t mean that he has sole right to the name. Even if you dropped the name Schiavo from the foundation name, we would all know that it was Terri`s foundation and support it. I personally always call her Terri Schindler, as do my friends, when we discuss her and the foundation.
